In accordance with the Digital Millennium Copyright Act (DMCA), it is our policy to respond to valid notices of alleged copyright infringement. If you believe that your copyrighted work has been used on our website, https://KitchenSak.com, in a manner that constitutes copyright infringement, please follow the procedure outlined below to submit a DMCA notice.

1. Filing a DMCA Notice

If you believe that your copyrighted work has been copied or is accessible on KitchenSak in a way that constitutes copyright infringement, please provide us with a written notification containing the following information:

  • Identification of the copyrighted work you believe has been infringed, or, if multiple copyrighted works are covered by this notice, a representative list of those works.

2. Counter-Notification

If you believe that the material removed or to which access was disabled is not infringing, or if you have authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to use the content in question, you may send a counter-notice containing the following information to our DMCA Agent:

  • Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or disabled.
  • Your contact information, including your full name, address, phone number, and email address.
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • A statement that you consent to the jurisdiction of the federal court in your jurisdiction and will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature.

Upon receiving a valid counter-notice, we may restore the removed content after 10 business days unless the original complainant files a court action to prevent the restoration of the material.

3. Repeat Infringers

KitchenSak reserves the right to terminate access for users who are repeat infringers of intellectual property rights.

4. Misrepresentations

Please note that under Section 512(f) of the DMCA, any person who knowingly misrepresents that material or activity is infringing may be subject to liability. KitchenSak will act on all notices that comply with the DMCA.
